These Terms of Service ("Terms") govern your use of the mobile application "SnapCal" ("the App") provided by Wei Wenxin ("Developer", "we", "us"). By downloading, installing, or using the App, you agree to these Terms.
1. Service Description
SnapCal is an application that uses AI to estimate calories and nutritional content from photos of food. It uses Google's Gemini API to recognize and analyze food items.
The App offers:
- Free tier: 3 free scans. Basic nutrition information display.
- Credit purchases: Consumable credits for additional scans (10/30/80 packs). Detailed macro breakdown, serving size estimation, and meal suggestions.
- Rewarded ads: Earn additional credits by watching video ads.
2. Important Notice About AI Analysis
The AI analysis results in this App are estimates and do NOT constitute medical advice.
- Calorie and nutrition estimates are based on AI image recognition and accuracy is not guaranteed
- Actual calories and nutrients may vary significantly depending on ingredients, cooking methods, and portion sizes
- If you have specific dietary restrictions, allergies, or medical needs, please consult a doctor or dietitian
- This App is not a medical device and is not intended to diagnose, treat, or prevent any disease
- Use the App only as a reference for diet and nutrition management
3. Credits and Purchases
- Credit packs: 10 credits / 30 credits / 80 credits (prices displayed in your regional App Store)
- Credits are consumable and cannot be restored after use
- Payment is charged to your Apple ID account upon purchase confirmation
- Unused credits do not expire
- Refunds are handled by Apple according to Apple's refund policy
4. Acceptable Use
You agree to use the App only for lawful purposes. The following are prohibited:
- Scanning non-food images to improperly use the AI analysis
- Reverse engineering, decompiling, or disassembling the App
- Circumventing usage limits or security measures
- Accessing the App via automated systems or bots
- Actions that damage other users or services
- Use for illegal, harmful, or fraudulent purposes
5. Intellectual Property
- Your photos: You retain all rights to the food photos you upload. By uploading a photo, you grant us a limited and temporary license to process it through AI services for the purpose of food analysis.
- Analysis results: AI analysis results may be used for your personal purposes.
- The App: All rights to the App's design, code, and branding belong to the Developer.
6. Disclaimers
Important:
- Calorie and nutrition values from AI analysis are estimates and accuracy is not guaranteed
- The Developer assumes no responsibility for health decisions made based on the App's analysis results
- The App is provided "as is" without warranties of any kind, express or implied
- We do not guarantee continuous, uninterrupted, or error-free operation of the App or AI services
- We do not guarantee the accuracy of data displayed through HealthKit integration
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the App, including but not limited to health issues, data loss, or service interruptions.
Our total liability shall not exceed the amount you paid for credit purchases in the App during the 12 months preceding the claim.
8. Termination
- You may stop using the App at any time
- We may suspend or terminate your access if you violate these Terms
- Upon termination, your right to use the App ceases, but provisions regarding intellectual property, disclaimers, and liability shall survive
9. Changes to These Terms
These Terms may be updated from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be interpreted in accordance with applicable laws. In the event of a dispute, the parties shall first attempt to resolve it through good-faith consultation before taking formal legal action.
